Who provides the service
Caption123 is provided by the individual developer identified on its App Store listing: Caption123 on the App Store . Caption123, we and us refer to that developer. These terms explain the Caption123 review and editing service. Contact details are provided below.
App license and your rights
The Apple Standard Licensed Application End User License Agreement governs your license to the app: Apple Standard EULA . These service terms supplement that license with the features, allowances and responsibilities described here; they do not replace it with a custom EULA. Nothing here removes mandatory consumer, privacy or other legal rights. If a provision conflicts with a right that cannot lawfully be excluded, that right takes priority.
The service and AI limitations
Caption123 helps you discover photographs worth sharing, understand a visible photographic strength and prepare optional crops, edits and captions. Suggestions are automated and can be inaccurate, incomplete, subjective or similar to results supplied to others. They are not a factual determination about a person, relationship or event. Review the image and every caption before relying on or publishing them. No particular photographic, learning, commercial or social-media outcome is promised. The service does not publish content for you.
Your content and permissions
You keep the rights you already have in your photographs. By submitting content, you authorize us and the processing providers described in the Privacy Policy to copy, process and temporarily store it only as needed to provide and protect the requested service. This does not grant us a right to publish your photos or use them to train our own models. You must have the rights and permissions needed to submit the content, including any permissions required by privacy, publicity or copyright law. You remain responsible for deciding whether and where to publish an output; we do not guarantee that generated text or edits are unique or cleared for every intended use.
Photo allowances
Your first review of up to 30 photographs is free. A completed review, including one with no highlights or no eligible photographs, uses this introduction. A review interrupted after a usable result also uses it; a technical failure or cancellation without a usable result does not. Starting on the next UTC calendar day after the introduction ends, free users can analyze up to 5 photographs per day. This daily allowance is not added on the day the introduction ends. Membership provides 100 analyzed photographs per day. Daily allowances renew at 00:00 UTC; unused photos do not roll over. Reviews contain up to 30 photos at a time, subject to the remaining allowance. Screening-excluded screenshots and reference images do not use photo allowance. A completed review with no highlights can still use allowance. A failed review with no usable result releases reserved photo allowance; a usable partial result can count.
Subscriptions, cancellation and refunds
The monthly subscription and any existing annual subscription are purchased through Apple. The App Store purchase sheet shows the price, billing period and any eligible introductory offer for your account. A trial exists only where offered to your Apple Account and may become a paid subscription as disclosed in that sheet. Subscriptions renew automatically unless cancelled using Apple subscription settings in accordance with the displayed terms. Deleting the app does not cancel a subscription. Restore purchases reconnects a verified active entitlement. You can request an Apple purchase refund through Apple purchase support and contact us about service problems. Refund and cancellation rights required by applicable law remain available; these terms do not create a blanket no-refunds rule.
Availability and service changes
Reviews depend on connectivity, Apple entitlement checks, hosting and AI-provider availability. Service-wide spending and abuse limits may temporarily delay or prevent a review even when photo allowance remains. The app is not a photo backup; preserve original photos and export results you want to keep. We may make reasonable changes needed for security, legal compliance, compatibility or continued operation. For a material reduction to a paid service, we will provide appropriate notice and any cancellation or other remedy required by applicable law. A service interruption does not by itself cancel an Apple subscription.
Acceptable use and suspension
Do not bypass allowances or security controls, impersonate another subscriber, misuse service credentials, disrupt the service or upload unlawful content. Do not use the service for harassment, non-consensual intimate imagery, exploitation of children, or infringement of another person’s privacy or intellectual property. We may proportionately restrict or suspend access where reasonably necessary to address a material breach, suspected abuse, a security risk or a legal requirement. Where practicable and lawful, we will explain the reason and how to contact us about a mistake. Suspension does not remove any refund or other remedy required by law.
Responsibility and limitations
We remain responsible for performing the service with the care and quality required by applicable law. We do not accept responsibility for a result being unsuitable solely because photographic taste is subjective, or for a publishing decision that you make despite an evident error in a suggestion. Any warranty disclaimers and liability limits in the Apple Standard EULA apply only where lawful. We do not exclude liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or remedy that cannot legally be limited. This includes mandatory rights relating to defective digital content or services. There is no guarantee of uninterrupted or error-free AI operation.
Resolving a problem
Please contact us with a description of the issue so we can try to resolve it. This is an invitation to seek support, not a requirement to give up a claim or delay a legal deadline. These terms do not impose mandatory arbitration, a class-action waiver or a requirement to use a foreign court. Applicable law determines your rights and the courts available to you, including protections available where you habitually reside.
Changes and remaining terms
We may update these service terms for changes to the service or applicable requirements. Material changes will be explained through the app or another appropriate notice, with any advance notice or consent required by law. Changes do not retrospectively remove rights or claims already accrued. If a term is unenforceable, the remaining terms continue to apply only to the extent that doing so is lawful and fair.
